Litigation (Civil)

Business & Personal Disputes

We are experienced in advising and representing businesses of all sizes and individuals in various areas of litigation including:

  • Contract matters
  • Arbitration
  • Mediation
  • International disputes
  • Professional negligence
  • Debt recovery and enforcement of judgements
  • Boardroom and shareholder disputes
  • Partnership disputes
  • Intellectual property infringement
  • Contentious wills and probate

We can be most effective if our advice is sought at the earliest possible opportunity, particularly as we can provide our clients with an early analysis of the potential costs which enables us to give consideration and advice as to the merits of alternative dispute resolution measures (see section below).

Resolving business disputes requires common sense as well as procedural expertise.  We will try to help you achieve a practical, cost-effective resolution of your dispute in a way that takes into account the realities of your personal or business life.  We will support you with early evaluation, negotiation and alternative dispute resolution all the way through to court action and enforcement.

If our clients become involved in court proceedings we provide clear advice on prospects and the likely outcome, strategy and cost benefit analysis from the outset and provide continuing, pro-active advice.

We have been involved in a number of cases reported in official series in England and other jurisdictions.

Alternative Dispute Resolution: Arbitration and Mediation

We have experience in all three areas of Alternative Dispute Resolution; adjudication, arbitration and mediation. We act on international disputes in various jurisdictions.

We encourage all our clients to consider alternative methods of resolving contentious disputes at the outset. Our experiences tell us that often early communication between parties to a dispute can result in settlement without the need to incur the significantly higher costs associated with Court proceedings.

Property Disputes/Landlord and Tenant

We also advise on landlord and tenant disputes for residential and commercial properties. This may involve your tenant falling behind with rent, breaching some other term of the tenancy or refusing to leave when the tenancy is terminated.  We have experience in seeking damages and in the eviction process, serving statutory notices, and issuing proceedings at Court for a possession order and enforcing that order.

We have experience in leasehold enfranchisement (the purchase of the freehold by the leaseholders of a property) and lease extension including representation at the Leasehold Valuation Tribunal.

Insolvency

We have experience in both issuing and defending winding-up petitions brought against companies in England and Wales.

In recent times the volume of debt recovery claims has increased and we are able to assist clients in recovering their debts.

We give advice to individuals and companies relating to various insolvency issues including bankruptcy, IVAs, CVAs, Preferences, and Sale at an Undervaluation
